Manu Sharma ? And why he was not punished?
Why other
accused friends of Manu Sharma , Coca-Cola Company officials Alok Khanna
and Amardeep Singh Gill, Shyam Sunder Sharma, Amit Jhingan, Yograj Singh,

Who
is D P Yadav?
A hardened
professional criminal is how the Uttar Pradesh police records describe
him. His name spells terror in several areas of Western Uttar Pradesh,
Haryana and Delhi.
Police rating
He is
rated a ‘B’ class history sheeter. Uttar Pradesh regulations classify
criminals into two categories — ‘A’ and ‘B’.
‘A’ class history-sheeter is described
as one who could be reformed over a period of time. ‘B’ class history
sheeter is one who cannot be reformed.
Significantly
neither the police nor the government is empowered to remove anybody’s
name from a ‘B’ class history sheet.
Police
records show that Yadav entered the big league of crime in 1979 when
the first case was registered against him in Kavi Nagar police station
of Ghaziabad district. Before that the police records described him
as a 'small-time goonda'.
He started
as a protégé of Mahendra Singh Bhati, a criminal turned politician,
who was then the block pramukh in Ghaziabad. With Bhati's patronage,
he got into the clandestine liquor trade, which got him quick money
and with that a bigger clout with politicians
Political
power
By 1989
he had earned enough notoriety to attract the attention of powers that
be and then chief minister Mulayam Singh Yadav (in his first stint)
promptly offered him a party ticket from Bulandshahr. He not only won,
but was also provided a ministerial berth in the Mulayam Cabinet. He
was made Minister of State for Panchayati Raj.
With political
power in his kitty, Yadav become one of the most dreaded mafia dons
of Western Uttar Pradesh within the next two years.
Criminal
career
By 1991
he had some 25 criminal cases registered against him. He gained so much
notoriety that the then chief minister Kalyan Singh slapped the National
Security Act on him and lauded the cops for putting him behind bars.
In 1992
he accused of murdering his mentor Mahendra Singh Bhati and chargesheeted
by the Central Bureau of Investigation. The case is still pending in
court.
Besides
being named in nine murder cases, other crimes listed against him included
three cases of attempt to murder, two cases of dacoity, besides several
cases of kidnapping for extortion, as also offences under the Excise
Act, Gangsters' Act, Goonda Act and even the Terrorist and Disruptive
Activities Act.
These
cases were listed in Ghaziabad, Bulandshahr, Moradabad, Budaun districts
of Uttar Pradesh besides Jind and Sirsa districts in Haryana.
In the
early nineties the Haryana Police in connection with illicit liquor
trading charged him. As many as 350 persons had died following consumption
of illicit liquor allegedly supplied by him.

Ramakrishnan, Supreme Court lawyer stated “If there could be a crystal
clear case of murder where direct evidence was available, it was
this case.
When a
murder took place in a public place, it is a matter of shame for the
police as well as the prosecution that all the accused have walked free.
It
is a clear case of procecution connivance with the accused.
The post-mortem
report and the site plan could have helped the police to counter the
two-weapon theory that had come about because of the suspected replacement
of cartridges due to an alleged conspiracy between the accused and certain
officials.

Lall was acting as a bartender for the noted socialite Bina Ramani at
her illegal restaurant Tamarind Court in Qutub Colonade when the incident
took place.
Siddharth
Vashisht, a.k.a. Manu Sharma, the son of Venod Sharma, a wealthy and
powerful Congress politician in Haryana.
Intense
media and public pressure, the prosecution appealed (a rare measure)
and the Delhi High Court found the lower court judgment, faulty in law,
and Manu Sharma was found guilty of having murdered Jessica Lall.
Subsequently,
a sting operation by the newsmagazine Tehelka exposed how Venod Sharma
paid bribes to win over key witnesses, and Venod Sharma resigned from
the Haryana Ministry on October 6th 2006,
Venod
Sharma was named in the expose as paying millions of rupees to some
of the witnesses.
One of
Manu Sharma’s aunts is a daughter of erstwhile President of India,
Shankar Dayal Sharma.
The high
court has ordered Shyan and other witnesses who turned hostile in court
to appear before it to explain why they should not be prosecuted for
perjury.

Solicitor - General Subramaniam and Delhi Police councel Mukta Gupta
opposed Vikas Yadav’s Plea alleging that he had committed a murder
while he was on bail in the Jessica Lal Case. They were referring to
the Nitish Katara murder case in which Vikas along with his cousim Vishal
is facing trial.
Despite

The Delhi
police today indicted Manu Sharma, Vikas Yadav and 10 others in the
Jessica Lal murder case. The chargesheet was filed in the court of Metropolitan
Magistrate V K Khanna.
The main
accused, Siddharth Vashisht alias Manu Sharma, has been charged under
sections 302 (murder), 201 (destruction of evidence), 120(b) (criminal
conspiracy) and 212 (harbouring suspects) of the Indian Penal Code and
sections 27, 54 and 59 of the Arms Act.
The post-mortem
was conducted at the All-India Institute of Medical Sciences.
At about
0200 hours, when the party was almost over, Sharma with his friends
Amardeep Singh, Alok Khanna, Amit Jhingan and Vikas Yadav, allegedly
entered the restaurant and demanded liquor from Jessica.
Sharma
fled from the restaurant with his friends in a Tata Sierra. According
to the chargesheet, he spent the night in Vikas Yadav’s Ghaziabad
house. The car was found abandoned in NOIDA.
Sharma
later surrendered and was arrested on May 6 in Chandigarh. He has been
in custody since then.
Ravinder
Krishan Sudan, Raja Chopra and Dhanraj have eluded the police.
Jessica
Lal was allegedly shot dead by Manu Sharma because she refused to serve
him a drink on April 29, 1999. Though the witnesses have denied that
Jessica was shot by Sharma, the family has not given up hope.
We are
aware of the pitfalls of the judicial system, particularly the delays
that contribute to certain problems. We are still hopeful that justice
will be done to us one day.
After
his deposition we were a little apprehensive. We realised we were battling
a party that has a lot of money and influence. We were apprehensive
that they must have worked on the eyewitnesses. It is possible they
have bought the other two witnesses also.
Prosecution
suffers setback when key eyewitness Shayan Munshi, turns hostile
and fails to identify Manu Sharma as the man who had fired the shot.
Manu Sharma,
son of a Congress party leader and minister in Haryana state, Vinod
Sharma, was the main accused in the case along with eight others.
On Tuesday
the court acquitted all nine citing insufficient evidence.
Eyewitnesses
at the time alleged that Lal was shot dead by Manu Sharma after she
refused to serve him a drink.
The eyewitnesses
later retracted their statements and the judge said the case presented
by the prosecution had several loopholes.
‘Shameful’
Expressing
surprise at the judgement, former chief justice of India, VN Khare,
said, “victims and their families should have the right to appeal
against the lower court judgement. Presently this right is with the
state, meaning the prosecution.
“Police
should have been alert against the use of money and muscle power in
the case. The commissioner should immediately order an inquiry into
the lapses.”
Supreme
Court lawyer Nitya Ramakrishnan says that Jessica Lal’s case highlights
glaring inefficiencies of both the police and the prosecution machinery.
The Delhi
police have come across several crucial aspects of investigations that
were not explored properly during the trial court proceedings in the
sensational Jessica Lal murder case that resulted in acquittal of all
nine accused.
Dr. R.
K. Sharma, who conducted the post-mortem, just deposed in the court
stating the cause of Jessica’s death, which was due to a head injury
caused by bullet that was ante-mortem in nature.
Some senior
police officers are of the view that the post-mortem report could have
been further explored to get at the truth. “Apart from the injury,
the size of the wound, its probable angle and other aspects could have
been put forth in a bid to connect the empties recovered from the spot
to the injury. A technical examination could also have helped in establishing
whether the bullet that hit Jessica was of .22 bore (the one owned by
the prime accused in the case) or any other bore,” opined one senior
police officer.
A Division
Bench of Justice R S Sodhi and Justice P K Bhasin expressed dissatisfaction
over the failure of Yadav’s counsel K N Balgopal to answer a query
repeatedly posed by them as to why Yadav cannot be tried for having
a common intention behind the murder of Jessica?
The Bench
asked him to file a written submission and said, “Take it seriously.
We issue a notice to you and you explain us why a case under section
302 (murder) read with 34 of iPC could not be made out against your
client”.
The prosecution
has charged Yadav with destruction of evidence under section 201 of
iPC. Yadav had allegedly removed prime accused Manu Sharma’s car from
the place of occurrence after the murder on the intervening night of
April 29-30, 1999.
On Tuesday,
the Bench had grilled Balgopal after he failed to impress the court
on a point that whether Tata Safari car, which Yadav had removed from
the spot, was a piece of evidence or not?
In his
argument, Balgopal denied the presence of his client in the party organised
at the Qutub Colonnade on the fateful night.
This case
has shocked the confidence of society in the criminal justice delivery
system,” the bench said, “but it cannot be said that the convict
would be a threat to society.”
Sharma
fled from the restaurant, leaving his car which was later moved by his
friends. During an intense hunt for Sharma over a week, three of his
friends were arrested, but Sharma himself went underground. His father,
Venod Sharma was asked to step down as Congress Party Chief in the state.
Eventually Manu Sharma surrendered on May 6 in Chandigarh. Subsequently
the fourth person, Vikas Yadav, son of D. P. Yadav, another heavyweight
minister from Uttar Pradesh with mafia connections, also surrendered
In a conversation
with the sister of Jessica, Karan Rajput is alleged to have played a
tape-recording [1] discussing with some friends how Venod Sharma’s
people have “won over” several witnesses already.
At the
trial, Shayan said that Manu Sharma had fired only once, and that also
into the air. He described Manu’s clothes carefully. Subsequently,
he said that another bullet, fired by someone else, was the one to hit
Jessica. About this man’s dress, he was evasive, and saying only that
he was wearing a “light-coloured” shirt. This led to the “two-gun
theory” - with the forensic report said that the bullets were fired
from different weapons.
In the
immense uproar that followed, hundreds of thousands of people e-mailed
and SMS-ed their outrage on petitions forwarded by media channels and
newspapers to the President and others seeking remedies for the alleged
miscarriage of justice. A poll conducted by the newspaper Hindustan
Times showed that on a scale of 1 to 10, the public’s faith in law
enforcement in India was about 2.7.
Public
pressure built up with newspapers splashing headlines such as “No
one killed Jessica”, and TV channels running SMS polls. Models, fashion
designers, friends, relatives and others have held candle-light vigils
at India Gate in New Delhi to protest the injustice of it all.
Surender
Sharma, the police inspector responsible for the investigation, was
transferred from the plum Hauz Khas position to a bureaucratic post.
The police have also launched an inquiry against the possibly deliberate
ineptness of their own earlier investigation.
Manu Sharma’s
lawyer, R K Naseem said the decision would be appealed in Supreme Court,
because the judgement was wrong in holding Bina Ramani to have been
an eyewitness.
There
was widespread celebration of Manu’s conviction on the media, where
it was seen as evidence that the people’s voice could move the wheels
of justice. Given the past record in India of cases such as Sanjeev
Nanda, it was felt that the Jessica Lall and Priyadarshini Mattoo convictions
finally indicated that even the most powerful were not above the law.
The submission
of counsel for Vikas Yadav, son of Uttar Pradesh politician D. P. Yadav,
that Vikas had already undergone the term of imprisonment did not impress
the Court to grant any relief to him.
